Mandatory job notification 2023

As a result of the COVID-19 crisis, the unemployment rate in Switzerland increased in 2021 and 2022, which is why the Swiss Federal Council had made additional types of occupations subject to the job notification requirement as of 2022. Furthermore, the only criterion for the job notification requirement is that the unemployment rate exceeds 5% in the respective sectors.
For the year 2023, there are significantly fewer occupational types subject to mandatory job notification. This primarily impacts the retail trade (retail trade employees, assistants, specialists) and the hospitality sector with the occupations of service specialists, bartenders, and cooks, which are no longer subject to mandatory reporting. In 2023, only 37 occupations will be reportable, compared to 63 in the previous years of 2021 and 2022. The full list is available on the arbeit.swiss website, which also offers an online check platform (Check-Up 2023) for employers.
Since the introduction of the job notification requirement, practice and the SECO study for 2021 show that 22% of all vacancies have been filled thanks to the job notification requirement. As a result, the job notification requirement increases the potential of hiring natives or permanent residents of any nationality, i.e. in principle every registered unemployed person in Switzerland.

Infolge der Covid-19-Krise stieg die Arbeitslosenquote in den Jahren 2021 und 2022 in der Schweiz an, weshalb der Schweizer Bundesrat seit dem Jahr 2022 weitere Berufsarten der Stellenmeldepflicht unterstellt hatte. Weiterhin ist das einzige Kriterium für die Stellenmeldepflicht, die Überschreitung einer Arbeitslosenquote von 5% in den jeweiligen Branchen.
Für das Jahr 2023 fallen deutlich weniger meldepflichtige Berufsarten aus. Änderungen gibt es vor allem beim Detailhandel (Detailhandelsangestellte, -assistenten, -fachleute) und im Gastrobereich mit den Berufen Servicefachkräfte, Barkeeper und Köche, die nicht mehr meldepflichtig sind. Im Jahr 2023 sind nur noch 37 Berufsarten im Vergleich zu 63 in den Vorjahren 2021 und 2022 meldepflichtig. Seit der Einführung der Stellenmeldepflicht zeigt die Praxis und die SECO-Studie für das Jahr 2021, dass 22% aller offenen Stellen dank der Stellenmeldepflicht besetzt wurden. Dadurch erhöht die Stellenmeldepflicht das Potenzial der Einstellungen von Einheimischen bzw. dauerhaften Aufenthaltern jeglicher Nationalitäten, also prinzipiell von jedem registrierten Arbeitslosen in der Schweiz.
Family reunification deadlines for third-country nationals

The family reunification of spouses and children under the age of twelve years who are third-country nationals must generally be claimed within five years.
On the other hand, the family reunification of children over the age of twelve years who are third-country nationals must be claimed within twelve months.
In the case of family reunification of:
- Swiss nationals Art. 47 Para. 1 AIG applies.
- Persons with a permanent residence permit (C foreigner's permit) Art. 47 para. 1 AIG applies
- Persons with a residence permit (B foreigner's permit) Art. 73 VZAE applies
- Provisionally admitted persons (F foreigner's permit), Art. 74 para. 3 VZAE applies
The periods for family reunification begin for foreign family members from third countries from:
- Swiss nationals upon entry or establishment of the family relationship (Art. 47 para. 3 let. a in conjunction with Art. 41 para. 1 AIG; no grace period in the case of Art. 42 para. 2 AIG).
- Persons with a permanent residence permit upon the granting of this permit or the establishment of the family relationship (Art. 47 para. 3 let. b AIG).
- Persons with a residence permit with the granting of this permit or with the establishment of the family relationship (Art. 73 VZAE).
- Persons with temporary admission with the possibility of family reunification three years after the order of temporary admission or when the family relationship comes into being (Art. 85 para. 7 AIG; Art. 74 para. 3 VZAE).
Familiennachzugfristen für Drittstaatsangehörige

Der Familiennachzug von Ehegatten und Kindern unter zwölf Jahre, welche Drittstaatsangehörige sind, muss grundsätzlich innerhalb von fünf Jahren geltend gemacht werden.
Hingegen muss der Familiennachzug von Kindern über zwölf Jahre, welche Drittstaatsangehörige sind, innerhalb von zwölf Monaten geltend gemacht werden.
Beim Familiennachzug von:
- Schweizerinnen und Schweizern gilt Art. 47 Abs. 1 AIG
- Personen mit Niederlassungsbewilligung (Ausländerausweis C) gilt Art. 47 Abs. 1 AIG
- Personen mit Aufenthaltsbewilligung (Ausländerausweis B) gilt Art. 73 VZAE
- Vorläufig Aufgenommenen (Ausländerausweis F) gilt Art. 74 Abs. 3 VZAE
Die Nachzugsfristen beginnen bei ausländischen Familienangehörigen aus Drittstaaten von:
- Schweizerinnen und Schweizern mit der Einreise oder der Entstehung des Familienverhältnisses (Art. 47 Abs. 3 Bst. a i. V. m. Art. 41 Abs. 1 AIG; keine Nachzugsfrist bei Art. 42 Abs. 2 AIG).
- Personen mit Niederlassungsbewilligung mit der Erteilung dieser Bewilligung oder der Entstehung des Familienverhältnisses (Art. 47 Abs. 3 Bst. b AIG).
- Personen mit Aufenthaltsbewilligung mit der Erteilung dieser Bewilligung oder mit der Entstehung des Familienverhältnisses (Art. 73 VZAE).
- Personen mit einer vorläufigen Aufnahme mit der Möglichkeit zum Familiennachzug drei Jahre nach Anordnung der vorläufigen Aufnahme oder mit der Entstehung des Familienverhältnisses (Art. 85 Abs. 7 AIG; Art. 74 Abs. 3 VZAE).
Cross-border commuter regulations with France and Italy

Yesterday, the State Secretariat for International Financial Matters in Bern announced the following concerning cross-border commuters:
France
The term "cross-border commuter" has been
redefined between Switzerland and France and regulated in a mutual
agreement between the two countries. Accordingly, as of 1 January
2023, the pursuit of gainful employment in the home office in the
country of residence is possible for up to 40% per year.
Previously, 45 overnight stays in the country of work were possible
without the cross-border commuter status being called into
question. This regulation remains unchanged.
This regulation is to be in force until 31 December 2024, provided that the supplementary agreement to the double taxation agreement currently being negotiated is signed before 30 June 2023. If the new supplementary agreement has not been concluded by that date, this mutual agreement will be suspended again.
Italy
It has been agreed between Switzerland and Italy that the currently existing mutual agreement of 18/19 June 2020 will remain in force until 31 January 2023. An extension is no longer envisaged thereafter.
It should be noted that the additional protocol of 23 December 2020 to the double taxation agreement between Switzerland and Italy is not yet in force.
Social security
Irrespective of this, the special regulation in the area of social security for cross-border commuters will remain in force until 30 June 2023. This means that the scope of the home office activity in the country of residence does not result in any change in the social security status.
Grenzgängerregelungen mit Frankreich und Italien

Gestern hat das Staatsekretariat für internationale Finanzfragen in Bern noch das Folgende im Bezug auf Grenzgänger bekannt gegeben:
Frankreich
Es wurde zwischen der Schweiz und Frankreich der Begriff des Grenzgängers neu definiert und in einer Verständigungsvereinbarung zwischen den beiden Staaten geregelt. Demzufolge gilt ab dem 1. Januar 2023, dass die Ausübung einer Erwerbstätigkeit im Homeoffice im Wohnsitzstaat bis zu 40% pro Jahr unschädlich ist. Bisher waren 45 Übernachtungen im Arbeitsortstaat möglich, ohne dass der Grenzgängerstatus in Frage gestellt wurde. Diese Regelung bleibt unverändert.
Diese Regelung soll bis zum 31. Dezember 2024 in Kraft sein, sofern das zur Zeit sich in Verhandlung befindende Zusatzabkommen zum Doppelbesteuerungsabkommen vor dem 30. Juni 2023 unterschrieben ist. Wenn das neue Zusatzabkommen bis zu diesem Zeitpunkt nicht ausgehandelt ist, wird diese Verständigungsvereinbarung wieder ausser Kraft gesetzt.
Italien
Es wurde zwischen der Schweiz und Italien vereinbart, dass die zur Zeit bestehende Verständigungsvereinbarung vom 18./19. Juni 2020 bis zum 31. Januar 2023 noch in Kraft bleibt. Eine Verlängerung ist für danach nicht mehr vorgesehen.
Zu beachten gilt, dass das Zusatzprotokoll vom 23. Dezember 2020 zum Doppelbesteuerungsabkommen zwischen der Schweiz und Italien noch nicht in Kraft ist.
Sozialversicherung
Davon unabhängig bleibt die Sonderregelung im Bereich der Sozialversicherung für Grenzgänger bis zum 30. Juni 2023 bestehen. Dies bedeutet, dass der Umfang der Homeoffice-Tätigkeit im Wohnsitzland keine Änderung in der Sozialversicherungsunterstellung zur Folge hat.
