Last week we wrote in detail about the upcoming USCIS policy change whereby the agency will commence  issuance of Notices to Appear (NTAs) for all denied benefit applications that result in applicants falling out of status.

Yesterday, USCIS announced that this policy will not be implemented as had been scheduled by July 28, 2018. USCIS has explained that the implementation of this policy is delayed until further notice because the agency has not timely published operational guidance to adjudicators and district offices. We will provide further updates as they develop.

Our firm remains available to address the overarching effects this significant change in policy will have on corporate global mobility strategies as well as acute cases where individual foreign nationals may now face removal proceedings and/or a denial in lieu of a Request for Evidence. Please contact us today for more information.
