Palo Alto – September 11, 2020 – Cooley advised Wyze Labs, creator of several smart home technology systems, on its complete victory against a patent infringement lawsuit brought by Sensormatic Electronics in the US District Court for the District of Delaware. Partners Reuben Chen and Erik Milch led the Cooley team advising Wyze. 

Sensormatic sued Wyze Labs in August 2019, alleging that Wyze's successful camera and sensor products, which are part of Wyze's core product offerings, along with Wyze's home-grown mobile applications, infringed seven patents. Cooley filed a Section 101 motion for judgment on the pleadings challenging the validity of all asserted patent claims. While the motion was pending, the parties vigorously litigated the case through claim construction briefing. Cooley won several discovery issues along the way and filed inter partes review petitions at the US Patent and Trademark Office against the asserted patents, which Sensormatic had reduced to five.  

Shortly before the claim construction hearing, US District Judge Colm F. Connolly found all asserted patent claims directed toward non-patentable subject matter and therefore invalid under 35 U.S.C. § 101, writing that "they are directed to the abstract ideas of wireless communication and remote surveillance and they do not contain an inventive concept."
