The U.S. Bureau of Economic Analysis (BEA) conducts the BE-12 benchmark survey of foreign direct investment in the United States every five years. Reporting is required of all U.S. business enterprises in which a foreign person or entity owns or controls, directly or indirectly, 10 percent or more of the voting securities of an incorporated U.S. business enterprise or an equivalent interest of an unincorporated U.S. business enterprise. The surveys for fiscal years ending in 2017 are due May 31, 2018.

Clients should review the BE-12 forms, instructions and guidance materials available on the BEA's website (link below). If you have questions regarding completing the survey, you may contact the BEA at be12/15@bea.gov or (301) 278-9247, any of the Fenwick attorneys with whom you work, or Fenwick attorney Ashley Walter.

The BEA's website also contains information regarding other required BEA surveys.
