An article in Bloomberg BNA's Pharmaceutical Law & Industry Report and other publications, "Medicare Releases Drug, Device Open Payments Data," discussed the recent annual release of data under the Open Payments program. Day Pitney's Eric Fader was quoted in the article.

Created under the Affordable Care Act, the Open Payments program requires manufacturers of drugs, devices, and other medical supplies to report to the federal government certain payments made to physicians and teaching hospitals. Payments in 2016 included $4.36 billion for research purposes, $2.8 billion in "general payments," and $1.02 billion in physician ownership or investment interests in drug and device manufacturers.

Eric told Bloomberg BNA that while it can be difficult for consumers to interpret the Open Payments data without additional information on the manufacturers' relationships with the payment recipients, the overall program has succeeded in creating a public dialogue around the payments and conflicts of interest.
