At a meeting held by the Berks County Chapter of the Society for Human Resource Management (SHRM), Fox Rothschild's Randall Schauer addressed an audience on topics related to workplace harassment as well as other pressing labor and employment concerns.

According to Schauer, there are several types of harassment that can take place in workplace. It's not always based on sex.

"It can be any harassment based upon what is called protected characteristics: race, religion, age, national origin, etc.," he said. "Any of that counts as harassment."

Schauer continued by mentioning that the No. 1 complaint filed last year was for retaliation.

"It's the easiest claim to prove as a plaintiff, because you don't have to prove you actually had a claim, you just have to prove that you thought you had a claim and you made a complaint," he said. "The next thing you know, your desk gets moved into the basement without any windows and away from everybody else, if you complain about harassment."

Once harassment is reported, investigations should be prompt, effective, remedial and confidential, Schauer said.
