The changes introduced by the amendments to the 1987 Use Classes Order have restricted flexibility in the use of properties, particularly those operating in the evening economy market such as casinos, nightclubs, restaurants and pubs. When purchasing or entering into new lease arrangements landlords, tenants and developers need to carefully consider the permitted use of the premises in light of these changes.
The changes that came into effect on the 21st April 2005 split the former A3 use into three distinct use classes, A3, A4 and A5. On 6th April 2006 casinos which previously fell within the D2 use class have been removed from that class and made a distinct use in their own right (a sui generis use).
