A transition period, which ends on 31 December 2020, was
recently agreed for the UK to implement its exit from the EU.
Registered EU trade marks (EUTMs) and designs (RCDs) will continue
to give protection in the UK during the transition period.
The EU Commission and UK government have agreed that EUTMs and
RCDs which are already registered before the transition period ends
should then be replicated on the UKIPO register as national rights,
keeping the same filing, priority and renewal dates. There will be
no re-examination. It has not yet been agreed whether this process
will be free of charge.
See link for text of the Draft Agreement –
only green text has been agreed at negotiators' level.
