Case: E-Privacy Directive

Ed Vaisey, Minister for Culture, Communications and Creative Industries, is reported to have said that he expects delays in the implementation of the new cookie regime required by the revised E-Privacy Directive. Under the Directive, cookies may only be used if the user has given prior informed consent. This has given rise to considerable concern within the industry. The implementation deadline is 25 May 2011, but the Government considers it unlikely that the necessary technical solutions will be ready by then. As the Directive will have the force of law from that date, the Government is stating that it does not expect the Information Commissioner's Office to take enforcement action in the short term.
