There have been some notable developments since the UK Supreme Court ruled on the lawfulness of litigation funding agreements in the PACCAR case in July 2023. The Competition Appeal Tribunal and the Commercial Court have already considered the implications and an amendment has been tabled to the Digital Markets, Competition and Consumers Bill in response to the Supreme Court's judgment.
