The Nabarro Employment team is delighted to invite you to attend its series of training events during 2015. Tailored for employment law and HR specialists, the seminars will focus on the practical and commercial implications of each relevant area of law.
The first of our seminars will focus on the Employment Appeal Tribunal's (EAT) recent decision about overtime being included in holiday pay calculations. The EAT found: where an employee is required to work overtime these payments should be included in an employer's calculations of holiday pay; and an employee's claim for unpaid holiday under the "unlawful deductions from wages" legislation is time limited. This decision will have serious implications for employers across the UK.
The seminar will focus on:
- the changes in legislation
- how they may affect your business
- practical advice on how you can manage these changes
This seminar will also discuss the anticipated decision of Lock v British Gas Trading Ltd following the ECJ's decision that holiday pay should include contractual commission in addition to basic salary. The case was referred back to the Employment Tribunal in order to determine whether domestic legislation can be interpreted in line with the ECJ's decision. The decision is expected on 4 February 2015.
In November 2014, Nabarro launched a survey to help us to understand how the recent holiday pay developments will impact on organisations and how they are planning to deal with the liabilities. The findings of this research will be revealed at the seminar and copies of the report will be available on the day.
