In a recent decision and regarding a free loan made by a company to another, the Court of Appeal of Bordeaux has considered that the favourable effect of some other operations on the maintaining of the European solvency rate is not a sufficient counterpart to the absence of remuneration for the advanced sums (C.A.A. Bordeaux, May 2, 1995, no. 93-699).
