On 18 November 2009, the Parliament of Ukraine overruled the President's veto and re-adopted amendments to the Law "On Radio Frequency Resource of Ukraine" (the "Law") .
The amendments included various changes to the procedure for re-registering licences for the use of radio frequencies. For example,.a legal entity is now required to re-register its licences for the use of radio frequencies if it reorganises its structure by way of separation (i.e. splits the business into three or more legal entities) or spin-off (i.e. where one part of the business breaks away to form a separate legal entity).
In addition, the amendments require a legal entity reorganised as a result of separation or spin-off to file for a new exploitation permit if the parameters of its frequency allocations change as a result.
The Parliament originally adopted the above amendments to the Law in June 2009. However, the President subsequently vetoed the law stating that the draft law, if it had been adopted, would have potentially resulted in ambiguity in the application of the Law's provisions related to the re-distribution of radio frequencies.
