Review of modern awards by Fair Work Australia

Fair Work Australia (FWA) has released a statement dealing with the review of modern awards as required by the Fair Work Legislation.

The Fair Work Legislation requires that FWA conduct a review of all modern awards [with the exception of modern enterprise awards and State reference public sector modern awards] as soon as practicable after 1 January 2012.

FWA has stated that the 'review will be based mainly on applications to vary modern awards. In some case FWA may also propose variations.' Applications are to be made by 8 March 2012.

What the Application needs to contain

FWA has indicated that the application should contain the following:

  • A brief outline of the submissions to be made
  • A brief outline of the evidence which will be called / relied upon.

FWA has also made clear that applications to vary a modern award which are not filed by 8 March 2012 will not be dealt with in the review process unless FWA decides otherwise.
