STOP PRESS: Vioxx appeal decision handed down by Full Federal Court

The Federal Court has allowed an appeal by the manufacturers of Vioxx, overturning a plaintiff's award of compensation.

Stop Press: The Full Federal Court of Australia has today handed down its decision in Merck Sharp & Dohme (Australia) Pty Ltd v Peterson [2011] FCAFC 128 in relation to the drug Vioxx.  Their Honours Keane CJ, Bennett and Gordon JJ allowed the Merck Sharp & Dohme appeal, overturning a previous ruling by his Honour Justice Jessup that awarded Mr Peterson compensation. No decision has yet been made in relation to the other individual group members who are members of the Australian class action.
