The ACCC has issued proceedings against Ray's Outdoors for claims made to promote the opening of its Elizabeth Street store in Adelaide. The advertisement appeared in The Advertiser in March 2007. It promoted an opening offer on the Rio Grand barbeque of $99, with a strike-through price of $299.99. The ACCC's claim is that:

  • the barbeque was not sold for $299.99 immediately prior to the sale; and
  • as a result, customers thought that they were receiving a saving much greater than they actually did.

Interestingly, the ACCC is not seeking a penalty. The first Directions Hearing will be on 14 January 2008
