The New York Attorney General's Office ("NYAG") launched an online whistleblower submission system to "attract, engage and protect whistleblowers."

The system, known as the N.Y.A.G. Whistleblower Portal, allows whistleblowers to communicate with the NYAG electronically and without compromising their identities. To submit complaints anonymously, whistleblowers must (i) download the TOR web browser, (ii) connect to the N.Y.A.G. Whistleblower Portal and (iii) upload their complaints and any relevant files. Individuals who submit information will use unique codes to communicate with the NYAG.

This is a significant step. Other states will likely follow suit. The ability to remain anonymous will almost certainly result in an uptick of whistleblower complaints; however, the increase may not be as significant as some may think. While whistleblowers' identities will technically remain anonymous, the information they share likely will not, thus increasing the chances that those close to the alleged wrongdoing will be able to identify its source.
