As of January 1, 2016, licensed residents in the states of Texas will lawfully be able to openly carry their holstered handguns.

One of the issues surrounding the recent change in law is how business owners should handle the prevention of individuals bringing firearms into their establishments.

With the new law in effect, business owners must post two signs outside of their business if they wish to prevent gun carriers from entering. In previous years the 30.06 prevented concealed carries from entering, but now owners must include a 30.07 to prevent open carries as well.

Fair enough, said Fox Rothschild's Mark Goodman.

"Business owners have to decide for themselves whether to allow or restrict open carry, concealed carry or both on their premises," he said.

If owners decide that the prevention of handguns is necessary, they must meet all of the state requirements for the signs or they will not lawfully be preventing individuals from entering.

If there are no signs, "they are not legally preventing people with guns from coming in," Goodman said.
