The current U.S. Citizenship and Immigration Services (USCIS) Form I-9, used by U.S. employers in the process of verifying employment eligibility, expires August 31, 2012.

As a new version of Form I-9 has not yet been released, the USCIS has instructed employers to continue using the current Form I-9, available at http://www.uscis.gov/, beyond the August 31, 2012 expiration date.

The USCIS further informs stakeholders that it will provide updated information about the new version of Form I-9 as it becomes available.

By way of background, all U.S. employers must complete and retain a Form I-9 for each individual hired for employment in the United States, including citizens and noncitizens. In order to accurately complete the Form I-9, an employer must examine and document evidence of employment authorization and identity, and retain certain records for access by the government if necessary.

Additional Form I-9 information and instructions, as well as this latest USCIS notice, can be accessed here.

Please feel free to contact any member of Proskauer's Immigration Group with questions or concerns about the Form I-9, and employment eligibility verification.
