A class action lawsuit recently settled with KT Health LLC and KT Health Holdings LLC ("KT Health"). The plaintiffs alleged that certain advertising claims regarding KT Health's KT Tape or "kinesio tape" was false and deceptive.

Specifically, the plaintiffs alleged that KT Health claimed that its KT Tape "can be used for hundreds of common injuries" and "provides 24 hour pain relief per application for days at a time through sweat, strain and humidity." Despite the allegations, the parties reached a settlement agreement which included $1.75 million payable to the members of the class.  Additionally, KT Health agreed to modify its labeling of their packaging and advertising of KT Tape.

TAKEAWAY:  Health claims continue to be on the radar of the class action bar.  Advertisers should continue to ensure that all health claims are backed by scientific evidence and research.
