On 13 October 2014, Vodafone commenced judicial review proceedings in the Irish High Court against ComReg aimed at requiring ComReg to consider the effect of the Three/O2 merger on Three's spectrum holding.

Proceedings were transferred at the end of 2014 from the Irish High Court to the Commercial Court – a fast track forum for resolution of legal disputes. Mobile network operators, Three and Meteor Mobile Communications Limited ("Meteor") are 'notice parties' entitling them to receive copies of the relevant court papers and participate in the proceedings.  The case was back in Court on 12 January 2015 for mention – and is now listed for hearing on 16 June 2015.  The court has provisionally set aside 6 days for the hearing.

Matheson is pleased to continue to act as legal advisor to Three.
