On October 18, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 837/PVTM-P2 regarding the issuance of the end-of-term review questionnaire in the case ER01.AD05 (the review of aluminum products investigation from China).

On October 3, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 2537/QD-BCT to conduct the end-of-term review of the application of anti-dumping measures against certain aluminum products imported into Vietnam originating from China.

In accordance with Article 57 of Decree No. 10/2018/ND-CP detailing a number of articles of the Law on Foreign Trade Management regarding trade remedy measures (Decree 10/2018/ND-CP), the Vietnam Trade Remedies Authority (the investigating agency) sent the end-of-term review questionnaire to:

(i) domestic manufacturing companies and

(ii) importing companies.

The deadline for submitting responses to the questionnaire is before 5:00 PM on November 28, 2023 (Hanoi time). The confidentiality of information is ensured based on the provisions of Article 75 of the Law on Foreign Trade Management and Article 11 of Decree 10/2018/ND-CP.

The questionnaire is publicly available on the websites of the investigating agency (www.pvtm.gov.vn) and the Ministry of Industry and Trade (www.moit.gov.vn).

To safeguard their rights and interests, related domestic manufacturers and importers are required to participate in responding to the questionnaire and cooperate fully throughout the investigation process.

Inadequate participation, such as not submitting responses on time, providing inaccurate information, or not meeting the agency's standards, may lead to the investigating agency using available data to make conclusions in the review, usually resulting in unfavorable duty rates for businesses.

This is implemented in accordance with Article 10 of Decree 10/2018/ND-CP regarding non-cooperation in trade remedy cases.

Detailed instructions on how to respond to each section of the questionnaire, the quantity to be submitted, the submission format, and the deadline for submission are provided in the questionnaire for businesses.
