On February 27, 2019, Minas Gerais Water Agency ("IGAM") published Ordinances No. 02 and 03, regulating specific matters of water dams' policy.
Among the innovations brought we highlight:
- Ordinance No. 02/2019: Regulates the National Dams Safety Policy ("PNBS"), regarding the periodicity of execution or update, the qualification of the technical responsible and the details of the (i) Dams Safety Plan; (ii) Periodic Safety Inspection; (iii) Special Safety Inspection; (iv) Periodic Review of Dam Safety; and (v) Emergency Action Plan;
- Ordinance No. 03/2019: Regulates the registration of users of water resources that have water dams, except for purposes of hydroelectric use, located in the water courses of Minas Gerais State.
