Introduction

After the abolition of the Intellectual Property Appellate Board (IPAB) by the Tribunal Reform Act 2021, the High Court such as the Hon'ble Delhi and Madras High Court in order to deal with matters relating to Intellectual Property Rights have their own set of functioning IP Divisions and Rules in place. Following the suit set by the Hon'ble Delhi and Madras High Court, the Hon'ble High Court of Karnataka is all set to have its own rules for its IP Division. This development notified by the Hon'ble High Court of Karnataka marks a significant step forward in streamlining and adjudicating matters dealing with Intellectual Property Rights in the state.

Content of the Notification

According to the notification circulated by an order of the Hon'ble Chief Justice of the Karnataka High Court on June 20, 2024, the Registrar (Judicial) of the Karnataka High Court and Dr. Arul George Scaria (Associate Professor of Law, NLSIU Bengaluru) have been appointed as members of the sub-committee and are tasked with preparing the draft rules for the establishment of the Intellectual Property Division in the Hon'ble High Court of Karnataka.

Subsequently, the draft rules will be presented to the Hon'ble Karnataka High Court and the District Judiciary Rules Committee for approval.
