On 1 January 2010, new public procurement regulations come into force affecting both contracting authorities and contractors.

The changes include:

  • changing to PLN 3.839 (from PLN 3.8771) the average exchange rate used to convert contract values into Euros
  • changing the value thresholds for contracts at or above which notice has to be given to the Office for Official Publications of the European Communities

The thresholds for supplies or services contracts will be €125,000, €193,000 and €387,000 (currently €133,000, €206,000 and €412,000 respectively), depending on the type of contracting authority.

The threshold for works contracts will be €4,845,000 (currently €5,150,000).

The new regulations replace the previous regulations of 19 December 2007 and affect those obligations of contracting authorities and contractors which vary according to the value of the procurement, such as the right of appeal.
