Ecuador: Contrato De Servicios Para Las Personas Privadas De Libertad

El Ministerio de Trabajo y el Ministerio de Justicia y Derechos Humanos y Cultos, mediante acuerdo interinstitucional No. 1-A publicado en el Registro Oficial No. 278 del 6 de julio de 2018 emitió la normativa que crea y regula el contrato especial de servicios para las personas que se encuentren cumpliendo una pena privativa de libertad. A continuación, un breve detalle.

Las actividades que serán reguladas por medio de la creación de este contrato especial de servicios incluyen la realización de actividades de carácter artesanal, intelectual, artístico, de manufactura, productivas u otras de acuerdo a sus conocimientos, capacidades y habilidades, durante el cumplimiento de la pena; y, gozarán de los derechos derivados de dicha relación contractual, bajo las condiciones propias del régimen de rehabilitación social.

El contrato será celebrado necesariamente por escrito, entre cualquier persona natural o jurídica de derecho público o privado en calidad de contratante previa autorización del Ministerio de Justicia y Derechos Humanos y Cultos, y personas que se encuentran cumpliendo una pena privativa de libertad. En razón de la celebración de este contrato especial, la persona privada de la libertad prestará sus servicios lícitos y personales por una remuneración fijada conforme al acuerdo de voluntades entre las
partes o la ley; y, deberá cumplir con los requisitos constantes en el artículo 7 de dicha normativa. La remuneración podrá ser percibida por la persona privada de libertad de forma diaria, semanal, quincenal o mensual.

En cuanto a la afiliación al IESS, ésta deberá ser cubierta totalmente por la persona privada de libertad, en tanto que la jornada de trabajo deberá ser la establecida por el Ministerio de Justicia y Derechos Humanos y Cultos.

De la suspensión del contrato: Además de las causales establecidas en el propio contrato, éste se suspenderá por la imposición de sanciones disciplinarias a la persona privada de la libertad prestadora del servicio; por razones de seguridad del Centro de Privación de Libertad que impidan temporalmente cumplir las actividades objeto del contrato; por comparecer a diligencias judiciales que imposibiliten su cumplimiento; y por las demás que establezca el Ministerio de Justicia.

De la finalización del contrato: el artículo 16 de la normativa en cuestión, detalla ocho causales por las cuales finaliza este tipo de contrato, dentro de las cuales consta la finalización del servicio, conclusión del plazo, incumplimiento de las obligaciones contenidas en el contrato, por la imposición de sanciones disciplinarias a la persona privada de la libertad prestadora del servicio superiores a ocho días; por cumplimiento de la pena; por realizar la persona privada de la libertad actividades ajenas al objeto del contrato.

Una vez concluido el “Contrato Especial por Servicios para las Personas Privadas de Libertad”, para el cual fue contratado, el prestador de servicios privado de libertad, el contratante de forma obligatoria deberá registrar en la plataforma informática del Ministerio del Trabajo, la liquidación de compra, misma que comprueba el pago de la remuneración o justo precio por sus servicios.

If you live outside the United Kingdom, English law shall apply only to the extent that English law shall not deprive you of any legal protection accorded in accordance with the law of the place where you are habitually resident ("Local Law"). In the event English law deprives you of any legal protection which is accorded to you under Local Law, then these terms shall be governed by Local Law and any dispute or claim arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts where you are habitually resident.

You may print and keep a copy of these Terms, which form the entire agreement between you and Mondaq and supersede any other communications or advertising in respect of the Service and/or the Website.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right. Rather, any such waiver or release must be specifically granted in writing signed by the party granting it.

If any part of these Terms is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the Terms shall continue in full force and effect.

Mondaq shall not incur any liability to you on account of any loss or damage resulting from any delay or failure to perform all or any part of these Terms if such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the control of Mondaq. Such events, occurrences or causes will include, without limitation, acts of God, strikes, lockouts, server and network failure, riots, acts of war, earthquakes, fire and explosions.
