The National Commission on Communication Regulation of Ukraine ("NCCR") adopted the Regulation on Quality of Telecommunication Services ("Regulation") so that it becomes effective from the day of its official proclamation, which is expected within a week from now.

The Regulation sets out requirements and legal grounds in relation to the protection of customers' rights to enjoy quality telecommunications services in a timely fashion.  For this, it imposes an obligation on to the telecoms operators to periodically inform their customers about the quality levels of the telecommunication services which the operators provide.

Under the Regulation, telecommunication carriers are obliged to announce certain information regarding the levels of the provided telecommunication services, including data on the achieved levels of the telecommunication services in the preceding year and the quality levels planned for the following year. Such information must be published (a) in either printed mass media or on the official web-sites of the carriers and (b) at their sale point locations no later than by 30th January of the year following the reporting year.

Significantly, the exact volume of the quality information to be reported by telecommunication carriers is not fixed in the Regulation, but will be determined by the NCCR on an annual basis in advance of the reporting year.

The figures of and other data about the telecommunication services quality, which are subject to mandatory publication, may be subject to their subsequent verification by the NCCR in its capacity as the specialised state controlled body overseeing the industry, or by the telecoms operators themselves.
