The U.S. Department of Health and Human Services' Office of the National Coordinator for Health Information Technology (ONC) just published a new guide to help hospitals and physicians better understand electronic health record (EHR) contracts, entitled "EHR Contracts Untangled: Selecting Wisely, Negotiating Terms, and Understanding the Fine Print." ONC issued a press release on September 26 to announce the availability of the guide and a new update to their Health IT Playbook, which also includes a discussion of EHR systems.

ONC had published a guide in 2013 entitled "EHR Contracts: Key Contract Terms for Users to Understand," which covered similar ground in much less detail. The new 53-page guide is intended to help healthcare providers better understand and manage the risks associated with EHR contracts and maximize the value of their IT investment – whether purchasing their first EHR system or upgrading or replacing existing technology.

While the new guide is not intended to substitute for legal advice, it provides extensive background information as well as specific and practical recommendations on contract provisions.
