Kenneth R. Berman, a partner in Nutter's Litigation Department and co-chair of the firm's Business Litigation practice group, wrote an article analyzing recent revisions to the Federal Rules of Civil Procedure and the effect on discovery in Litigation, the Journal of the American Bar Association (ABA) Section of Litigation, in its Spring 2016 issue. In the article, "Reinventing Discovery under the New Federal Rules," Ken details past rule revisions and what has changed in the new rules, as well as providing an outline on how to use the new rules to advantage. He also discusses in depth both changes in approach and how the new rules affect discovery responses. Ken notes that the success of the news rules cannot be measured by how much or how little evidence is obtained or produced—it is measured by whether the overall quality of justice increases.
