Due to the recent Pennsylvania Supreme Court election, the Democratic Party now holds a 5-2 majority, which is leaving many uncertain of the impact that this will have on the state's business community.
Over a decade ago, the Supreme Court reduced the amount of medical malpractice cases by "requiring plaintiffs to produce a certificate of merit for their case and limiting venue shopping."
Fox Rothschild's Joshua Horn said that most cases that make it to the state appellate level are personal injury matters and not business disputes.
"No one really campaigned on tort reform so I don't know if this realignment will have much effect," Horn said. "But it's possible the court could loosen restrictions on venue shopping and certificate of merit. And that would be big."
