As the threat and cost of data breaches increase, government officials are placing a stronger emphasis on the "legal and regulatory repercussions" associated with companies and their efforts to avoid cyber-attacks.

"The courts are starting to shift in a direction where they're imposing liability on companies that experience data breaches, and I think companies are cognizant of this trend in litigation," says Purcell. "It's causing companies to take a good hard look at their data security practices and procedures."

She continues by emphasizing key responsibilities of the boards of directors in association with cyber security. Purcell states, "Boards need to make sure that they have the right people on their staff to handle these types of issues, whether it be people from an IT perspective or from a legal perspective."
