In 2013, a jury awarded $5.05 million to the Belgravia Condominium Association, after finding the developer, 1811 Belgravia Associated and PMC/Belgravia Associates, along with engineering firm O'Donnell & Nacaarato failed to disclose certain property defects to the buyers.
On Thursday, the Pennsylvania Superior Court found that O'Donnell is still on the hook for $350,000 for his part in the alleged misrepresentations.
The three judge panel broke down the arguments, saying the plaintiffs' evidence was plausible and O'Donnell was responsible for the defects that were overlooked and for failing to review the building's public records, which are required by the Uniform Condominium Act (UCA).
"Now that the Superior Court has ruled, we are hopeful that the litigation will be concluded promptly and that our client, the Belgravia Condominium Association, will be compensated in full for its damages," said Robert Tintner, the association's attorney.
