Should states opt to "just say no" to U.S. EPA's Clean Power Plan proposal by either not submitting compliance plans or creating mechanisms that do not follow the agency's building blocks?  Peter Glaser in Troutman's D.C. office discussed that question with E&E TV's Monica Trauzzi this week.  Peter posited that the end result under either a federal or state plan might essentially be about the same; however, states choosing to sit by and wait for a federal take-over may be in a better position, given the legal vulnerability of the rule and the state's desire to avoid appearing responsible for the impact to the economy that may result from EPA's plan.
