The Office for Civil Rights (OCR) of the Department of Health and Human Services has ratcheted up its enforcement of violations of the privacy, security, and breach notification rules under the Health Insurance Portability and Accountability Act (HIPAA). In response to growing public concerns about compromises to privacy and security resulting from data breaches, we are seeing increasingly aggressive enforcement activities by OCR and certain state attorneys general. HIPAA settlement fines stemming from data breaches are increasing and OCR has committed to conducting more examinations of covered entities and business associates under the HIPAA audit protocol.
