A resolution to move forward with the pursuit of Galaxy Gardens by means of eminent domain may have been added to the agenda for a January Woodcliff Lake meeting.

In November, the council rejected a resolution to not proceed with Phase II of an environmental assessment of Galaxy Gardens, and thus the condemnation of it. The majority agreed it was too costly to remediate the entire 2.1-acre site, which had been estimated to cost the town between $700,000 and $1 million.

While the remediation cost was a concern among the council, Councilman Carlos Rendo claims the town possesses $1.5 million in open space money and the town expects to receive an additional $180,000 from the state in open space money in January. Rendo wishes to see the site transformed into a recreational area for children and redesign the Werimus Road and Woodcliff Avenue intersection to make it safer.

On Dec. 8, Ernest Badway, representing The Responsible Neighbors and Residents of Woodcliff Lake, Inc., addressed a letter to the mayor and council stating his client's intention to pursue legal action against the town if any council member associated with Our Lady Mother of the Church favors the condemning of Galaxy Gardens and votes this resolution to move forward with the condemnation process. The letter also contends a conflict of interest with Rendo for his affiliation with Our Lady Mother of the Church, due to its proximity to Galaxy Gardens.

Badway insists, "The church has no interest in the property."
The letter also claims the church, due to its contiguous location to the Galaxy Garden, would experience a "direct benefit from the condemnation proceeding."

He also clarifies that while the letter does not identify what the benefit would be, the church would not be "inconvenienced" by the nursery and that there wouldn't be any "parking situations."
