IV. Declaratory Ruling Request 142

Martins, LTD hereby petitions the Alabama CON Review Board for a declaratory ruling finding that Martins is the owner of the rights conferred under that certain certificate of need number 1792-SCALF issued on February 28, 2001, granting 16 specialized assisted living facility (SCALF) beds to Martinview Assisted Living Facility-East, which is currently licensed as a 16-bed SCALF.

The request for declaratory ruling was withdrawn by Martins, LTD due to a settlement the parties reached at the CON Review Board meeting.

Pleasant Properties, the operator of the current facility, will keep the currently existing CON, and Martin, LTD is granted the emergency CON requested below.

AL2013-051, Martins, LTD, Tuscaloosa, AL: Emergency application requesting 16 SCALF beds as the fee owner and lessor of Martinview East so that Martins may continue to offer SCALF services after the termination of the leasing relationship with Pleasant Properties.
