Mark Prefontaine, Alberta's Superintendent of Insurance, has announced the 2016 adjustment to the maximum minory injury amount (also known as "the minor injury cap"), increasing it to $4,956, up 1.3 percent from the 2015 maximum.

If you have sustained a soft tissue and/or psychological injury due to someone else's negligence, do not assume your recovery is necessarily limited to the amounts prescribed by the Minor Injury Regulation. Contact one of Miller Thomson LLP's personal injury lawyers to discuss how the courts have interpreted this legislation, and whether or not the facts of your case likely fall within/outside of "the cap" on minor injuries.
