Many people encounter problems in their daily lives. Many of these problems are dealt with outside of the courts. However, where cases go to court over "daily life troubles', it can be useful to learn from the result. Automobile leases are common in Ontario. Two recent cases dealt with disputes over the return of the leased vehicle.
The dispute can be whether the vehicle was returned or not. In Landmark v. Mister Twister Inc., 2014 ONSC 1436, the leasing company complained that the vehicles had not been returned and the defendants said the vehicles had been returned. The defendants did not recall the day they returned vehicles. The defendants had nothing in writing from the leasing company to confirm that the company received the vehicles and keys. This case shows that it is prudent to document the return a leased vehicle.
