European Union: In arrivo: la nuova direttiva UE per la protezione dei whistleblower

Uno dei cambiamenti legali più radicali nella UE sarà presto approvato in maniera definitiva dal consiglio dei ministri UE. WhistleB accoglie con piacere la maggiore tutela dei whistleblower, e invita caldamente le organizzazioni interessate a usufruire dell'apposito Resource Centre per iniziare il proprio percorso di compliance.

"Il trattamento dei whistleblower è cambiato drasticamente. La nuova legge riconosce che i whistleblower possono giocare un ruolo fondamentale a favore di una società più trasparente, anche sul luogo di lavoro," sostiene Karin Henriksson, Fondatrice e Partner di WhistleB, il fornitore di servizi funzionali alla segnalazione anonima per centinaia di aziende e istituzioni europee dal 2011.

Secondo la nuova direttiva, aziende con 50 dipendenti o più sono obbligate ad adottare canali di segnalazione interni. La legge inoltre specifica gli obblighi per questi canali interni, ad esempio che dovrebbero garantire l'anonimato di chi segnala e iniziare azioni a seguito di una segnalazione.

La direttiva UE per la protezione dei whistleblower dovrà essere implementata dai Paesi Membri entro 2 anni dall'adozione, il che fissa la data di scadenza a settembre 2021. La segnalazione anonimà sarà così regolata a livello nazionale, e ci si aspetta che diventi una prassi accettata nella maggior parte dei Paesi UE.

"L'esperienza dei nostri clienti ci insegna che la garanzia dell'anonimato è un fattore fondamentale nell'incoraggiare chi segnala a farsi avanti. Ciò nonostante," continua Karin Henriksson, "ci rassicura che per la prima volta aziende e istituzioni dovranno rispondere in maniera chiara a un segnalante anonimo, e inoltre dovranno offrire la possibilità di riportare a organi esterni all'organizzazione. In tal caso, chi segnala dovrà ricevere lo stesso livello di protezione qualora la segnalazione alla propria organizzazione non dovesse andare a buon fine, ad esempio per mancanza di un dialogo o di azioni da parte dell'organizzazione."

Per aziende e organizzazioni, gli obblighi principali introdotti della direttiva UE per la protezione dei whistleblower sono:

  • Canali sicuri: canali che garantiscano discrezione per chi segnala e per chi viene chiamato in cause in una segnalazione. Questi canali devono allo stesso tempo impedire l'accesso a persone non autorizzate.
  • Competenza: la selezione di una o più persone imparziali assegnate a seguire le segnalazione. Questo ruolo include anche la comunicazione con il segnalante per richieste aggiuntive o per feedback.
  • Feedback e follow-up: avviso di avvenuta ricezione della segnalazione entro 7 giorni, e una risposta (feedback) riguardante le azioni a seguito della segnalazione (follow-up) entro 3 mesi. È inoltre richiesto un processo diligente a seguito della segnalazione, e ciò vale anche per le segnalazioni anonime, dove le leggi nazionali lo prevedano.
  • Segnalazione alle autorità: informazioni chiare e facilmente accessibili riguardo la possibilità di ricorrere ad autorità esterne all'organizzazione.
  • Diverse opzioni di segnalazione: i canali devono consentire la possibilità di denunciare per iscritto oppure a voce, attraverso linee telefoniche o altri sistemi di comunicazione vocale, o, se richiesto, in un incontro privato.
