Comparison website concerning the fees related to payment accounts made operational by the Commission de Surveillance du Secteur Financier (CSSF)

The website is one of the elements implementing into Luxembourg law the requirements of Directive 2014/92/EU on the comparability of fees related to payment accounts, payment account switching and access to payment accounts with basic features (the Payment Accounts Directive).

The website, managed by the CSSF, does not pursue a commercial purpose but undertakes to show to the public in a transparent and objective manner the fees applied by providers of certain payment services under the CSSF's supervision. The results displayed are limited to the most representative services linked to payment accounts.

Anti-Money Laundering (AML)

The FATF's2 revised risk-based approach guidance for the securities sector (the Revised Guidance) was made applicable in Luxembourg by the CSSF

The Revised Guidance seeks to implement the risk-based approach for a wide range of securities products and services, including investment funds. It notably provides examples of risk factors and indicators to be considered by market participants and regulators in their activities.

According to the CSSF, "the FATF guidance complements the existing Luxembourg regal and regulatory AML/CFT framework (...) and has thus to be read in conjunction with the latter."

AML

CSSF issued Circular 18/701 on FATF statements regarding certain high-risk AML countries

The circular informs supervised entities of FATF's recent statements concerning jurisdictions whose AML regime (i) has substantial and strategic deficiencies, (ii) requires the application of enhanced due diligence measures, or (iii) is not satisfactory. The CSSF requires the supervised entities to employ enhanced due diligence and monitoring measures in this respect.

Bill of law n°7373 on the limitation of the scope of certain rights and obligations under Regulation (EU) 2016/679 (the GDPR) introduced

Based on the option offered by article 23 of the GDPR, the bill of law aims to introduce specific limitations to the rights, granted to individuals by the GDPR, in the areas of competence of the CSSF and the Luxembourg insurance supervisory authority (Commissariat aux Assurances – the CAA), to ensure the efficient performance of the CSSF's and the CAA's missions in the general interest.

Circular 18/700, clarifying certain points of the Law of 13 June 2017 on payment accounts (the Law), published by the CSSF

The Law implemented the Payment Accounts Directive. The circular sheds light on the provisions of the Law that only entered into force on November 1, 2018, including the fee information document, the statement of fees, use of standardized terminology, comparison websites and collection of statistical information by the CSSF.
