There are going to be introduced some amendments to the provisions re: employment of foreigners in Poland. The amendments will be effective from 1 January 2018.

One of the proposed changes is the amendment to the rules re: registration of declarations about intention to assign work. It is a special, simplified procedure of employment of citizens of, among others, Ukraine or Russia. It is not necessary to obtain a work permit for such person. It is enough for the employer to issue a declaration about intention to assign work, which is next registered by the labour office. New regulations give the labour offices additional competences in this area. The labour offices will verify more meticulously the fulfillment of the conditions for the registration of such declarations, in particular, whether the employer is really going to employ a foreigner and comply with labour law regulations. The duration of the registration process will be extended to a maximum of 30 days. At the same time, the possibility of applying the simplified procedure will also be extended to cover citizens of a few other countries.

The new regulations also introduce new type of work permit – seasonal work permit. It will entitle its holder to work in Poland for up to 9 months in the calendar year. In order to obtain such permit, the future employer will have to obtain the so-called information from the County Head (starosta) about inability to find an employee for a given position among unemployed people at the local market(although citizens of some countries will be exempted from this requirement).
