The standard of business tourism area is regulated under the Minister of Tourism and Creative Economy Number 17 of 2014 on Standard of Business Tourism Area ("MR No 17/2014"). Standard of business tourism area is a formulation of qualification of business tourism area and/or qualification of business tourism area which includes aspect of product, services, and management of Business Tourism Area. Business tourism area is a development and/or management of area to fulfill the needs of tourism.
Certificate and Certification of Business Tourism Area
Every business tourism area must have the certificate of business tourism area and certification of business tourism area. The certification of business tourism area is conducted according to the standard of business tourism area that is set forth in the annex of MR No. 17/2014, which covers aspect of product, services and management.
For the needs of certification and issuance of certificate of business tourism area, the Institute of Tourism shall assess:
- Fulfillment of the basic requirements, which are registration certificate of business tourism in field business of tourism area. If the basic requirements are not complied, then the certification may not be conducted.
- Fulfillment and implementation of standard of business tourism area covers the aspects of:
- Product, divided into 2 (two) elements and 6 (six) sub elements;
- Services, divided into 1 (one) element and 6 (six) sub elements;
- Management, divided into 4 (four) elements and 24 (twenty four) sub elements.
After obtaining the certificate of business tourism area, the tourism entrepreneur authorizes to organize and may postulate themselves as business tourism area. If the business tourism area is no longer comply with and conduct the standard of business tourism area, then the tourism businessman is obligated to comply with and/or fix the requirements in maximum period of 6 (six) months since the first knowing of the fact thereof. In the event of the term of after 6 (six) month, the tourism business shall not comply with and/or fix the requirements, then such tourism business is prohibited to organize business tourism area, and the certificate of business tourism area is not applicable.
Administration Sanction
Any tourism entrepreneur that does not have the certificate of business tourism area and does not comply with and/or fix the requirement under standard of business tourism area in period of 6 (six) months, shall be imposed an administration sanction. The administration sanction may be in the form of (i) written warning, (ii) restriction of business tourism area activities (iii) freezing or revocation of registration certificate of tourism business.
