Our e-update issued on 12 May provided details of the draft Code produced by the Home Office relating to the prevention of illegal working, which came into effect in May. This Code made certain changes to the document checks that employers must carry out in order to have a statutory excuse if it transpires that they have unknowingly employed an illegal worker.

The Home Office recently created an online tool which some employers might find useful in relation to these document checks. This tool takes employers through the process of checking documents.


The final Home Office Code that employers should follow can be found here. Further changes to this Code are expected later in the summer, and MacRoberts will report on these changes when they are made.
