On the 2nd June 2014 the MFSA commenced a consultation process with respect to proposed amendments to the Tenth Schedule to the Companies Act. The Tenth Schedule is applicable to  partnerships en commandite (or limited partnerships) established as collective investment schemes in terms of article 66A of the Companies Act and the current Tenth Schedule to such Act.

The proposed amendments to the current regime are rather extensive and have the ultimate aim of ensuring that the provisions of the Tenth Schedule to the Companies Act will be workable for private equity funds.

Following the consultation process, the amendments will be effected through a Legal Notice which will be issued in terms of article 425 of the Companies Act (Chapter 386 of the Laws of Malta).
