Yesterday, the Environmental Protection Agency (EPA) released its proposed rule to establish "User Fees for the Administration of the Toxic Substances Control Act." The proposed rule outlines a series of fees to be imposed on entities subject to requirements under Section 4 (chemical testing and submission requirements), Section 5 (requirements to seek EPA authorizations for new chemicals and new uses of chemicals), and Section 6 (prioritization and evaluation of chemical risks) of the Toxic Substances Control Act. The fees outlined in the proposed rule would be imposed later this year and remain in effect during Fiscal Years 2019-2021.

The publication of the proposed rule begins a 60-day comment period. Parties interested in providing feedback to EPA on the proposed rule must submit comments to the Agency by April 27, 2018.
