The Department of Health has finally released the new Medical Marijuana Treatment Center ("MMTC") license application and proposed rules, all of which can be found at http://www.floridahealth.gov/programs-and-services/office-of-medical-marijuana-use/mmtc-applicants/index.html. DOH is yet to release the date it will begin accepting applications, and the deadline for when applications must be submitted. Though Florida Statutes Section 381.986 provide that certain new licenses must be issued no later than October 3, 2017, the window is closing on when these applications can be finalized and reviewed. Many aspects of this new application set it apart from the prior license applications- there are preferential points awarded to certain applicants in the citrus industry, applicants must submit a diversity plan for the operations, the applications are subject to a blind scoring process and heightened requirements are imposed on MMTCs regarding production of edibles and packaging of any medical marijuana products for patients.
