On October 18, 2017, Counsel William Thomashower and Associate Ryan Klarberg of Pryor Cashman's Intellectual Property Group will present a CLE lecture through the Clear Law Institute entitled "Trademarks, Domain Names & Cybersquatting." Their presentation will examine the Uniform Domain Name Dispute Resolution Policy (UDRP) and the Anticybersquatting Consumer Protection Act (ACPA), including how they differ and how to respond when clients find domain names simulating or "squatting" on their trademarks. Participants will also learn how to represent domain name holders on the receiving end of cease and desist letters claiming cybersquatting.

Additionally, the lecture will explore:

  • The administrative and statutory regimes for combating cybersquatting via the UDRP and ACPA;
  • The expectations and demands of proof of each regime;
  • Which legal regime is most appropriate for vindicating client's rights given certain facts;
  • The fundamental elements of cybersquatting claims and defenses;
  • The evidentiary requirements for asserting claims and defending rights to domain names;
  • How to assess the merits of cybersquatting claims;
  • Remedies for cybersquatting; and
  • Other economic considerations.
