Kramer Levin filed an amicus brief in the U.S. Court of Appeals for the D.C. Circuit on behalf of Leon G. Billings and Thomas C. Jorling, two environmental policymakers and advocates who served in the U.S. Senate environmental committee as lead drafters of the 1970 Clean Air Act (CAA). The brief supports the United States Environmental Protection Agency's (EPA) Clean Power Plan, which aims to regulate the greenhouse gas (GHG) emissions from the nation's existing power plants under the CAA. The Plan is the centerpiece of the Obama Administration's effort to reduce GHG emissions in connection with last year's Paris Agreement, and seeks to reduce GHG emissions from the power sector by 32% below 2005 levels by 2030.
The amicus brief details Mr. Billings' and Mr. Jorling's unique experience drafting the law and their understanding of how the Plan is fully within EPA's authority under the Act.
