A judge recently denied discharge to Daniel Gordon, who previously pleaded guilty to conspiracy, wire fraud and money laundering in defrauding Merrill Lynch.

The IRS came after Gordon for taxes related to the $43 million after he spent 22 months behind bars, prompting him in 2009 to launch his Chapter 7 after attempts to settle failed.

Gordon withheld disclosure of dealings and gave excuses that "helped destroy his credibility and, quite frankly, insulted the intelligence of the court," noted the judge.

Gordon's lawyer said an appeal is in the works.

If Gordon can't prevail on appeal, debts on his schedules will not get wiped out, said Yann Geron, the attorney for trustee Angela Tese-Milner.
