Foreign and Investment Review Board (FIRB) Issues: New Foreign Investment Policy
The Foreign and Investment Review Board (FIRB) has just released a new foreign investment policy, which sets out its approach when assessing foreign investment applications under the Foreign Acquisitions and Takeovers Act 1975. Among other things, the policy defines the term ‘foreign governments and their related entities’, and outlines the factors FIRB will take into account when considering if a proposed investment is contrary to Australia’s national interest.

ASIC Widens Share Purchase Plan Relief for Custodians and Trustees
Australian Securities and Investment Commission (ASIC) released its updated policy on Share Purchase Plans (SPPs). The policy widens the ability of those who hold securities as custodians or trustees to participate in SPPs, rectifying what had been considered as deficiencies in the relief in the previous policy. ASIC Proposed Changes To Capital Raising Regulatory Requirements
Earlier this year, ASIC released a consultation paper calling for submissions on a number of changes proposed in order to remove certain existing regulatory impediments to capital raising. ASIC have now received submissions and expects to release policy documentation relating to the proposals in May 2009.
